The Grand Duchy of Lithuania (henceforth.
-
GDL) was a complicated conglom¬
eration of separate lands which relations with
Viľno
were not the same in the before
Statutes times. The absence of the single legislation for the whole state which could
regulate relations between the grand duchy authority and dependent on it territories, led
to the situation when the population of the lands had different rights. For the improv¬
ing of the legal situation in regions and settling interconnections between the central
authority and the local, the grand Lithuanian dukes granted to the regions' population
ustavnye zemskie gramoty or landed privileges. The standards of these privileges defined
legal, judicial-administrative and socio-economic principles concerning each region be¬
fore the First Lithuanian Statute adoption (September
1529).
Among Ukrainian lands of
the GDL only Kievschina and Volyn' received the landed privileges (information
about the other regions is absent). Therefore the basic attention in this monograph
is paid to these regions.
The first part of the monograph
-
Sources and Historiography
-
is dedicated to the
historiography and source study survey. The foundation of the research source base is
formed mainly by texts of the landed privileges to Kievschina and Volyn'. All of them
are the confirmation privileges that could be dated from the beginning
-
the first third
of the 16th century, because their protographs did not remain till nowadays. According
to the classification of sources concerning the history of Ukraine of the 15th
-
16th
ceturies the landed privileges related to the legislative texts of the judicial-adminis¬
trative, public-law, private-law or socio-economic nature. At the moment five landed
privileges to the abovementioned regions appear available for the scientific analy¬
sis: three to Kievschina (December
8, 1509;
September
29
and October
24, 1529)
and
two to Volyn' (February
16, 1501
and August,
1508).
We also used the acted sources
(pubUshed and archives) for the studying of the landed privileges functioning in the
everyday practice of the GDL. Among them are: different privileges (ownership,
confirmation, with entitlement to hold a governmental position, etc.); documents
of the legal procedure (sentences, testimonies, pledges, contracts, economic let¬
ters, etc.); economic (the purchase and sale and change of property contracts, lease
agreements, receipts, etc.) and social nature (testaments,
veno).
The exposition of historiography is divided into three groups. The first group
consists of the historical and legal nature literature which is directly devoted to the
given problem. The second group deals with the pure historical works concerning the

GDL history which reflected issues about legal development of Kievschina and Volyn'.
The third group is formed by the source study works concerning Lithuanian
Metrika
and
Lithuanian Statutes analysis.
In the second part
-
The landed privilege to Kiev land
-
the legal aspects of the re¬
lations between the grand duke authority and local population have been analyzed. In
the beginning we attempted to establish the date of the landed privilege to Kievschina
protograph granting. The comparison of the Kiev privilege of
1507
and
1529
with the
all-land privilege of
1447
and Novogrudok privilege of
1440
enable us to decline the
hypothesis about its archetype genesis during the rule of the grand Lithuanian duke
Vitovt. At the same time it is possible to assume that the first privilege to Kiev land
was granted by the grand Lithuapian duke
Kasimir Jagiellonian
in the second half of
1440.
Henceforth we examine the practical functioning of the landed privileges articles
and the role of the grand Lithuanian duke and his officials in this process. The main
was problem during the study of the property relations the absence of links in docu¬
ments upon the landed privilege. However, as the sentences, confirmation privileges
and other documents witnessed the articles of the landed privilege had some practical
use. The standards concerning the legal procedure system, in most cases did not have a
declarative nature, but used, as the sources witnessed, in the everyday life. Besides that,
the comparative analysis of the three versions of the privilege snowed the evolutional
changing of the separate articles and the writing of the new articles which expanded the
rights of Kiev land population in considerable degree. The landed privilege standards
also regulated the economic relations, particularly, taxes and fees payment, working off
by the gentry's serves different duties {storozhovschina, giving carts [podvoda], fish¬
ing, hay mowing, beaver hunting, repairing of the towns fortifications). Separate articles
touched up holding of the governmental positions and the procedure of trip out of the
GDL territory.
The landed privileges to Volyn' were analyzed in the similar manner in the third
part of the monograph. The comparative analysis of the two confirmation privileges
allowed us to reconstruct their protograph. In our opinion, it consisted of

articles
and was granted by the
Kasimir
Jagiellonian in the beginning of
1452.
The stan¬
dards which provided the functioning of the legal procedure system are extensively
represented in it. For example, the person could be put on trial only by the written
charge while the case itself was regarded in the presence of the grand Lithuanian duke
order. The main official person during the trial was the elder
(starosta),
but he was per¬
mitted to judge princes, masters and Volynian
boyars
without assistance. At
thé
same
time the gentry received a right to judge their serves with the exception of four types
of crime: raid, rape, putting bodily injures to the noble and arson. These cases were
under the elder's jurisdiction. Besides that the princes, masters and
boyars
were
allowed to pass the case consideration into the next level, i.e. directly to the grand
duchy chancellery, for the so-called "highest law".

The articles of the landed privileges to Volyn' concerning the economic relations
regulation is laconic enough. Therefore in the process of their practical realization we
come across different quantity of cases and local privileges which
cpntęnts
helps to
reconstruct the historical-legal base of the region economic life. In particular, the
inhabitants of different towns were granted exemptions from some kind of fees. As far
as the duties are concerned, in the version of the privilege of

it was prohibited to
collect "volovschina" and "pomernoe" from the gentry's serves (it was allowed only in
case of the state need). At the same time, the landed privilege to Volyn' did not re¬
flect such important duties as giving carts or military ones (the existence of which is
confirmed by the sources). The Volynian gentry received a prerogative to collect
fine for murder
-
"golovschma" from their serves. This fine used to be under the
elder's or deputy's jurisdiction.
In the fourth part
-
"Starina"
and
"novina":
the customs law and legislation
initiative
-
we analyzed relations between the central authority and the local from
the point of view of the policy declared by the government
-
observation of
"starina"
[old tradition]. This policy was formulated in postulate "my
stanný
ne rukhaem,
a novin ne
wodini' ["do not disturb old tradition while did not introduce new
custom"]. The analysis of legal nature sources showed that principle about the
firmness of
"starina'
did not correspond to the realities of the Lithuanian policy
concerning the local legislative traditions observation. At the same time, the exam¬
ined economic sources, in particular purchase and sale of property contracts witnessed
that the gentry of the GDL actively used the advantageous
"noviny'
in everyday
practice.
This conclusion is proved by the results of the comparative analysis between
the standards of the landed privileges and the articles of the Ruskaya
Pravda ["Rus'
Law"]. In particular, the impact of the last can be traced in the separate case of
public and criminal legal relationships. Therefore it is incorrect to talk about direct
reception of the oldrus' law heritage in the GDL. The necessity in appellation to
"starina"
gradually disappears owing to domination of the written law in society
-
the
First Lithuanian Statute adoption in September
1529.
From the one hand, the Stat¬
ute became the original
"novina"
for the society, but from the other
-
it completely
functioned in the judicial practice. It was possible because the Statute absorbed
"constitutional" rights of the annexed land of the GDL, including Ukrainian, and the
unwritten norms of the customs law.
The monograph ends with the main conclusions, list of the used sources and
literature and appendices, which contain the archeography publication of the landed
privileges to Kievschina and Volyn'.

ВКЛ) было сложным конгломерат
отдельных земель их отношения с
Бильним

период. Отсутствие единственного для всей страны законодательства, которое
бы регулировало отношения великокняжеской власти с зависимыми от нее
территориями, привело к тому, что население земель имело разные права. Поэтому
для улучшения правовой ситуации в областях и урегулирования взаимосвязи
центральной власти с местной, великие князья литовские жаловали обитателям
земель уставные земские грамоты или областные привилеи, нормы которых и
определяли, к изданию Первого Литовского Статута (сентябрь
1529
г.), правовые,
судебно-административные и социально-экономические принципы каждого
региона. Среди украинских земель ВКЛ уставные земские грамоты получили лишь
Киевщина и Волынь (о других регионах информации нет), потому именно этим
регионам и посвящено основное внимание в монографии.
В первой части

Источники и историография
-
осуществлено
источниковедческий и историографический обзор. Основу источниковой базы
исследования составляют, преимущественно, тексты областных привилеев
Киевщины и Волыни. Все они есть подтвердительными грамотами начала
-
первой
трети
XVI
в., поскольку до нашего времени архетипы не сохранились. Согласно
классификации источников истории Украины
XV-XVI
в. уставные земские
грамоты принадлежат к законодательным текстам судебно-административного,
публично-правового, частнопра
""Boro
и социально-экономического характера. В
наше время доступными для научного анализа является пять уставных земских
грамот указанных регионов: три Киевской земле
(8
декабря
1509
г.,
29
сентября и
24
октября
1529
г.) и две Волынской
(16
февраля
1501
г. и август
1508
г.). Документами
для выяснения функционирования уставных земских грамот в повседневной
практике стали актовые источники (опубликованные и архивные): разнообразные
привилеи (имущественные, урядницкие, подтвердительные и др.), источники
судопроизводства (приговоры, свидетельства, залоги, соглашения, хозяйственные
письма и т. п.), экономического характера (соглашения купли-продажи-обмена
недвижимости, арендные грамоты, квитанции и т. п.) и социального (завещания,
веновые записи).
Весь комплекс историографического достояния распределен на три группы.
Первую группу составили труды историко-правового характера, которые имеют

непосредственное отношение к указанной теме. Во второй рассмотрены сугубо
исторические труды по истории ВКЛ, в которых нашли отображение вопросы,
касающиеся правового развития Киевщины и Волыни, Третью группу составили
источниковедческие труды, связанные с исследованием Литовской Метрики и
Литовских Статутов.
В содержание второй части
-
Уставная грамота Киевской земле
-
проанализировано правовые аспекты взаимоотношений между великокняжеской
властью и местным населением. Сначала осуществлена попытка установить дату
пожалования протографа уставной грамоты Киевщине. Сравнение содержания
Киевского привилея
1507
г. и
1529
г. с общеземским
1447
г. и Новогрудским
1440
г. позволило сделать вывод о неприятии гипотезы происхождения архетипа с
времен великого князя Витовта и в то же время сформулировать предположение,
что первую грамоту Киевская земля получила с рук в. к. л, Казимира Ягеллончика
во второй половине
1440
г. Дальше рассмотрено практическое действие артикулов
привилея и роль в этом процессе великого князя литовского и его урядников.
Наиболее существенной проблемой в разделе имущественных отношений
оказалось отсутствие ссылок в документах на областной привилей. Однако,
как свидетельствуют приговоры судебных дел, подтвердительные привилей
и другие документы, статьи уставной грамоты имели практическое действие.
Нормы, касающиеся системы судопроизводства, также в большинстве не носили
декларативный характер, а использовались, как подтверждают источники, в
будничной жизни. Кроме этого, сравнительный анализ привилев трех редакций
показал эволюционное изменение отдельных статей и дописывание новых, что
значительно расширяло права населения Киевской земли. Нормы уставной грамоты
регулировали также экономические взаимоотношения, в частности уплату налогов
и пошлин, отбывания разнообразных повинностей шляхетскими подданными
(сторожовщина, подводная повинность, ловля рыбы, сенокос, охота на бобров,
ремонт городских укреплений). Отдельные статьи касались получения урядницких
должностей и процедуры выезда за пределы ВКЛ.
Аналогичное исследование было проделано с грамотами Волынской земле в
третьей части книги. Сравнительный анализ двух подтвердительных привилеев
позволил реконструировать их протограф. На наш взгляд, он состоял с

статей
и был пожалован Казимиром Ягеллончиком в начале
1452
г. Наиболее широко в
нем представлены нормы, которые обеспечивали функционирование системы
судопроизводства. Например, привлечение к суду было возможным только
посредством письменного обвинения, а дело решалось при наличии распоряжения
великого князя литовского. Главным лицом судебного процесса был староста,
однако ему запрещалось самостоятельно судить князей, панов и бояр Волынских.
В то же время, подданные были подсудны своим собственникам, за исключением
обвинений в совершении преступлений четырех категорий: наезд, изнасилование,
нанесение телесных повреждений шляхтичу и поджог, компетенция которых
принадлежала старосте. Кроме этого, князьям, панам и боярам разрешался

перевод рассмотрения дела на так называемое "высшее право"
-
непосредственно в
великокняжескую канцелярию. Достаточно лаконичны артикулы уставных грамот
Волыни относительно урегулирования экономических отношений. Поэтому в
процессе их практической реализации мы встречаем разнообразное количество
судебных дел и локальных привйлеев, содержание которых помогает воссоздать
историко-правовую базу экономической жизни региона. В частности, обитатели
разных городов освобождались от уплаты некоторых видов пошлин. Относительно
повинностей, то редакцией
1508
г. с шляхетских людей запрещалось собирать
"воловщину" (разрешалось только в случае государственной необходимости) и
"померное". В-то же время, в областных привилеях Волыни вообще не отображены
такие важные повинности, как подводная или военная (наличие которых
подтверждается источниками). Также прерогативой волынской шляхты стало
собственноручное взыскание с своих подданных штрафа за убийство
-
"годовщину",
что раньше было компетенцией старосты или наместников.
В четвертой части
-
"Старина" и "новина": обычное право и законодательная
инициатива
-
рассмотрены отношения центральной власти с местным населением
с точки зрения декларируемой правительством политики соблюдения "старины",
которая формулировалась принципом "мы старины не
рухаєм,
а новин не вводим".
Анализ источников правового характера засвидетельствовал, что нерушимость
"старины" не была реальностью литовской политики относительно соблюдения
местных законодательных традиций. В то же время, рассмотренные экономические
источники.вчастностиактыпокупки-продажинедвижимости.засвидетельствовали,
что шляхта ВКЛ активно использовала в повседневной Практике выгодные
"новины". Этот вывод подтверждают также результаты сравнительного анализа
норм уставных земских грамот с положениями Русской Правды. В частности,
влияние последней просматривается лишь в отдельных случаях гражданских
и криминальных правоотношений, поэтому говорить о непосредственной
рецепции
староруського
правового наследства в Великом княжестве Литовском не
совсем корректно. Необходимость апелляций к "старине" постепенно исчезает в
результате доминирования в обществе кодифицируемого права
-
изданием Первого
Литовского Статута в сентябре
1529
г., который с одной стороны, стал своеобразной
"новиной" для социума, ас другой
-
полностью функционировал в судебной
практике. Причиной этого стало то, что Статут составили "конституционные"
права аннексированных земель ВКЛ, в том числе и украинских, а также неписаные
нормы обычного права.
Книга завершается общими выводами, списком источников и литературы и
дополнениями, в которых осуществлена археографическая публикация уставных
земских грамот Киевщины и Волыни.
